By ticking the "I have read and accept the Let’s Carpool terms and conditions" box and submitting your application you agree to be bound to the following terms and conditions of use.

Purpose

1. Let’s Carpool of the Greater Wellington Regional Council (GWRC, “us”, “our” or “we”) is an online system that provides a matching system that allows individuals to find and accept carpooling arrangements. Use of the system is voluntary and entirely at the discretion of participants. The website is offered free of charge and strictly as a convenience and service to commuters seeking carpool-matching services.

Privacy

2. You agree that the information submitted by you will be entered into the regional carpool database. Matches are made via computer and based on proximity of origin and worksite addresses and work schedules.
3. If you have agreed to be matched with potential carpool partners, they will receive your contact information via letter, email or web page. They will not receive any information that you decide to keep confidential, according to the selections you made in the registration form.
4. Your information will not be provided to any outside entities for any commercial purpose. If your employer has chosen to administer carpooling at your workplace the workplace administrator will only be able to view records for your workplace. An overall website administrator from a territorial authority or regional council may be able to view records from within their geographic boundaries. We may provide personal information about you to your employer, the police or other government authorities where we believe it is reasonably necessary to protect your safety or the safety of other people you have been carpooling with where these carpoolers have been organised directly or indirectly through the website.
5. You agree that we might also disclose your personal information to third parties when we believe in good faith that we are required to do so by law.
6. You agree that we reserve the right to also share participation reports and programme statistics with its subscribing entities, e.g. your employer, tertiary institution or the local or central government for statistical reasons.
7. You agree that we may contact you for programme evaluation and feedback purposes.

Security

8. Participation in our carpooling service is an individual decision. When you register you will be provided with a user ID and password. You must ensure that your password is kept secure and confidential and that it is not revealed to any person. You are entirely responsible for any and all activities that occur under or through the use of your password.
9. We are committed to your privacy and strive to protect the personal and confidential information of those who use our website. However, as no data transmission over the internet can be guaranteed to be completely secure, we cannot ensure or warrant the security of any information you transmit or receive through the website. These activities are conducted at your own risk.

Limitation of Liability

10. Access to this website and use of this website is provided as a free service to enable you to organise rideshares. As such, without limiting any rights you may have under the Consumer Guarantees Act 1993, to the fullest extent permitted by law you agree that carpoolers are completely responsible for the operation of their carpools. In consideration of your becoming a member with our website, you acknowledge and agree to waive any and all rights to, or claims for, damages (including special and consequential damages), costs, expenses, proprietary or personal injury (including death), or any other compensation of any kind whatsoever against us and our partners, that arise directly or indirectly with respect to your use and/or reliance on the information provided in this website, your membership with this website and/or your use of the carpool services and agree to indemnify and hold harmless us and our partners for same.

Exclusion of Warranties

11. You acknowledge and agree that you will be using the information provided in this website at your own risk and that we and our partners are in no way responsible, and provide no warranty (express or implied) and/or guaranty of any kind with respect to, the information provided herein. You acknowledge and agree that it is your responsibility to select the carpool co-participants who are most appropriate for your needs.

Registered User Conduct

12. You acknowledge and agree that it is solely your responsibility to insure that you have adequate insurance coverage to protect yourself and your passengers.
13. You acknowledge that we reserve the right to revoke your membership and remove you from the system if it is determined that you are using the website for a purpose or in any other means which are considered to be other than the intended purposes.

14. We reserve the right to modify this agreement at anytime, without prior notice and such modification shall be effective immediately upon posting on the website. It is your responsibility to review this agreement periodically and make yourself aware of any modifications. Your continued use of this site will be deemed to be your conclusive acceptance of the modified agreement.
15. If you wish to terminate your status as a registered user of the website your only recourse is to discontinue your use of the website. Upon termination, your right to use the website immediately ceases. Linking

GWRC will not be responsible for the contents of any linked site or liable for any direct or indirect loss or damage suffered by you from accessing, using, relying on or trading with third parties. These links are provided to you only as a convenience, and the inclusion of any link does not imply our endorsement of the site or any association with their operators. We reserve the right to prohibit links to the website and you agree to remove or cease any link upon our request. You may not frame any part of the website material by including advertising or other revenue generating material.
